12 hour shifts

Good evening brothers and sisters. As the holiday season reaches its peak, I wanted to give you an update on our current efforts to bring all facilities guaranteed 12’s for the foreseeable future. This would mean the state cannot take 12’s away, like they did at NNCC and Stein. FOP has been driving at this on your behalf for a long time.


As we saw with the NNCC 12’s arbitration, it was upheld that the state could take the 12’s away under the CBA and they can choose how to manage the 12’s. What we are currently working on is a proposal that would secure the 12’s moving forward with permanent language to ensure that this WILL be the schedule moving forward at all NDOC facilities and Stein Mental Health Facility. FOP is also working to guarantee the 4 hours of overtime (short day) is built into the schedule. This doesn’t mean that there will not be any 8 hour shifts available. There will be some posts that are not appropriate for 12 hour shifts. We have proposed to have input on which posts are 12's and which are not at each facility.


FOP has pushed for our side of this and the following is what is currently on the table as what the state wants in return. Keep in mind none of this is final and there are additional items that they would like to discuss. The state is asking for 15 minutes of Muster Pay, meaning that instead of 45 minutes of Muster per day, every officer would receive 30 minutes of Muster per day. This would be a dead wash for the positions that are switching from 8's to 12's, if the 4 hours of built in overtime is agreed to. They wish to settle the Holiday RDO grievance by having us agree to the guidance issued back in July. The state also wants accountability for employees showing up on time to their posts to receive the muster pay. There are additional issues that they would like to address, but there are no final details or proposals at this time.


Keep in mind that when you consider these concepts right now that the NDOC has the discretion to remove 12's and not hire you for the 4 hours on your short day. The vast majority of our members have expressed the desire to have a work life balance with 12's and the results of taking them away at NNCC and Stein are clear and obvious, mandatory overtime is up and morale is in the toilet. We aim to serve the best interests of all of our members. I know that this will kick off a lot of discussions, but I urge you to keep in mind that in collective bargaining you have to give something to get something. Those of you who already have 12's just imagine what it would be like to lose 12's. Keep in mind if we can reach an agreement, you would be guaranteed the 4 hours of overtime, as opposed to this being optional. Nothing is final and we will keep you updated as this evolves.
