Back pay

Hello Brothers and Sisters,

 

This e-mail is concerning backpay and stale claims owed to our members and nonmembers. We are collaborating with our attorney to come up with a way to force NDOC and the state to pay off all stale claims. There are a few mechanisms that will be utilized to force this to happen. Some of them, depending upon the dollar amount of what is owed will be overseen by our attorney, and some of them will have to be pursued by officers in small claims court. I will be making a list of everyone who contacts me, and we will be sending out any necessary paperwork required that you need to complete.

Be advised, if your claim does not reach the threshold amount required by law to go to Justice Court or District Court, it will have to go to small claims court without the help of an attorney. We will assist you and supply you with the paperwork and the instructions needed to complete this process yourself.

Currently, I need you to send me the total amounts that are owed to you by the state. With a short recap of what they are for.  We may need a more detailed recap in the future. 

IE: Backpay, OT, muster, shift differential, etcetera.

Example:

1 week back pay  $800 

5 days OT   $2400 

15 days PSD  $180 

 = $3380 total  with your FOP membership number
